BUILDING REQUIREMENTS

THESE ARE SOME OF THE REQUIREMENTS FOR BUILDING IN BANEBERRY. THIS IS NOT AN OFFICIAL DOCUMENT AND IS NOT INTENDED TO INCLUDE ALL OF THE IN PLACE ORDINANCES. THIS IS INTENDED ONLY AS A HELPFUL AID AND AN ANSWER TO FREQUENTLY ASKED QUESTIONS.

1. ALL OF THE BELOW REQUIRED DOCUMENTS TO OBTAIN A BUILDING PERMIT MUST BE SUBMITTED TO THE BUILDING INSPECTOR 10 DAYS PRIOR TO THE NEXT SCHEDULED PLANNING COMMISSION MEETING:

(1) A COMPLETED PERMIT APPLICATION

(2) A CHECK OR CASH FOR PERMIT FEE

(3) TWO COMPLETE SETS OF BUILDING PLANS.

PLANS MUST:

BE LEGIBLE
NOT BE PENCIL DRAWINGS
BE STRAIGHT LINED (NOT FREE HAND) & DRAWN TO SCALE
CONSIST OF FOUNDATION PLAN & DETAILS,  FLOOR PLAN, ELEVATIONS, AND SECTIONS AND
MUST SHOW ALL BEDROOMS.

(4) A SEPTIC SYSTEM PERMIT FROM THE HEALTH DEPARTMENT (TOM CARTER-865-397-2823)

(5) A PLOT PLAN, BY A LICENSED SURVEYOR OR ENGINEER, SHOWING THE LOCATION OF THE NEW BUILDING INCLUDING ALL SET BACKS.

2. HOUSES MUST HAVE THE MINIMUM LIVING AREA FOR SINGLE FAMILY AS REQUIRED BY SUB-DIVISION RESTRICTIONS. LAKELAND: 1500 SQ. FT. FOR SINGLE FAMILY.1000 SQUARE FEET FOR CONDOS.
LANDS
END: LOTS 1 THRU 25 -  ONE STORY: 1650 SQ. FT.  TWO STORY: 950 SQ. FT. ON FIRST FLOOR AND A MINIMUM OF 1800 SQ FT. TOTAL. LOTS 26 THRU 65 ONE STORY: 1500 SQ. FT.  TWO STORY: 950 SQ. FT. ON FIRST FLOOR AND A MINIMUM OF 1650 SQ. FT. TOTAL. NINA FERRY LANDING: ONE STORY: 1650 SQ. FT.  TWO STORY: 1200 SQ. FT. ON FIRST FLOOR AND A MINIMUM OF 2300 SQ FT TOTAL. DO NOT COUNT GARAGES OR PORCHES.

3. EXISTING LOTS MUST BE ADEQUATE TO ACCEPT BUILDING AND REQUIRED AREA FOR SEPTIC SYSTEM. NEWLY CREATED LOTS MUST BE A MINIMUM OF 20,000 SQ FT PLUS 3000 SQ FT FOR EACH ADDITIONAL UNIT IF YOU ARE BUILDING A CONDO OR APARTMENT.

4, IF YOU BUILD ON AN UNDEVELOPED STREET, THE CITY WILL NOT BE RESPONSIBLE FOR IT’S MAINTENANCE, HOWEVER, THE CITY, THROUGH A FACILITATION PLAN, WILL AID PROPERTY OWNERS IN PAVING UNIMPROVED OR UNDEVELOPED STREETS. THE ENTIRE COST WILL BE ASSESSED TO THE PROPERTY OWNERS. CONTACT THE ROAD COMMISSION FOR INFORMATION ABOUT THE FACILITATION PLAN.

5. THE SITE PLAN MUST SHOW METHOD OF DRAINAGE. YOU WILL NOT BE PERMITTED TO ALTER ROADSIDE DITCHES FROM THEIR APPROVED DESIGN. LONG STEEP DRIVEWAYS MUST BE PROPERLY DRAINED SO EXCESS WATER DOES NOT ENTER THE STREET. ALL DRAIN PIPES UNDER DRIVEWAYS MUST BE A MINIMUM OF 14 INCHES IN DIAMETER UNLESS APPROVED BY THE ROAD COMMISSION.

6. ALL ELECTRICAL MUST BE UNDERGROUND FROM SERVICE POLE TO HOUSE.

7. YOU MAY NOT ALTER YOUR APPROVED BUILDING PLANS WITHOUT APPROVAL FROM THE BUILDING OFFICIAL

8. IF YOU CALL FOR INSPECTION AND ARE NOT READY, YOU MAY BE CHARGED FOR AN ADDITIONAL INSPECTION.

9. SET BACKS:  LAKELAND-YOU MUST GET YOUR FRONT SET BACK BY MEASURING 55 FT. FROM THE CENTER OF THE EXISTING STREET. REAR YARD IS 30 FT. SIDE YARDS ARE 15 FT. LANDS END: 30 FT. FRONT & REAR . 10 FT SIDES . NINA POINT: 30 FT. FRONT & REAR. 15 FT. SIDES.

10. ADDITIONS TO EXISTING BUILDINGS MAY NOT BE MORE THAN 2 STORIES AND NO MORE THAN 1000 SQ FT PER STORY. ALL CONSTRUCTION, DESIGN AND MATERIALS, MUST MATCH THE EXISTING STRUCTURE. EXCEPTION: IF MATCHING MATERIALS ARE NO LONGER AVAILABLE, MATERIALS OF LIKE KIND MAY BE USED IF APPROVED BY THE PLANNING COMMISSION AND/OR THE BUILDING OFFICIAL.

BUILDING ORDINANCES
 

ORDINANCE NO. 200-5

AN ORDINANCE GOVERNING THE CONSTRUCTION OF ADDITIONS TO
PRIVATE RESIDENCES

WHEREAS, the City of Baneberry’s Planning Commission has requested the City Commission to enact an ordinance requiring that all additions be attached to a property owners’ private residential structure; and

WHEREAS, the City Commission feels the best interests of preserving the aesthetic elements of the City would be served by enacting said regulations.

NOW, THEREFORE, BE IT ORDAINED by the City Commission of Baneberry that the construction of additions to residences shall be governed as follows:

Section 1. It shall be unlawful to erect any type of outbuilding except as described in "accessory buildings". All other building additions must be attached to the main building.

An "outbuilding" shall be deemed to be any building not attached to the main structure, such as a garage, barn etc.

Section 2. The addition shall be deemed "attached" if it is connected by the roof or a wall that is the height of the roof line. All exterior construction shall match the existing structure.

Section 3. The nearest wall of the addition shall not be more than eight feet from the connecting point of the main structure. The connecting wall shall not be considered as the "nearest wall".

Section 4. The addition shall be no more than two stories. Each story shall have no more than one thousand square feet of usable space. Space may be used as a garage or living area.

Section 5. All Construction, design and materials, must match existing structure.

Section 6. The ordinance shall take effect immediately upon the passage of its second and final reading, the public welfare requiring it.

ORDINANCE NO. 203-6
AN ORDINANCE FOR ADOPTION OF
BUILDING CODES FOR THE
CITY OF BANEBERRY, TN

WHEREAS, the City of Baneberry’s Planning Commission has requested the City Commission to enact an ordinance adopting the 2000 International Residential Code for one- and two- family Dwellings and the 2000 International Building Code for commercial buildings establishing the minimum regulations governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures; known as the Building Code.

NOW, THEREFORE, BE IT ORDAINED by the City Commission of Baneberry, Tennessee
as follows:

Section 1. That two certain documents, of which copies are on file in the office of the Building Official of the City of Baneberry with one being marked as the 2000 International Residential code for one- and two- family dwellings, excluding Appendix 7 and one being marked as the 2000 International Building Code as published by the International Code Council, Inc. be and is hereby adopted as the Building Code for the City of Baneberry in the State of Tennessee; for the control of building and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted, and made part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance.

Section 2. The following sections are hereby revised:

Section 3. That Ordinance Number 93-8 of the City of Baneberry, Tennessee, entitled "AN ORDINANCE OF THE CITY OF BANEBERRY, TENNESSEE, AMENDING ARTICLE X, ENFORCEMENT, AND SHALL INCLUDE BOTH ORDINANCE 90-1 AND 92-3 AS WELL AS ORDINANCE 92-6."
and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 4. This ordinance shall take effect immediately upon the passage of its second and final reading, the public welfare requiring it.

ORDINANCE NO. 203-7
AN ORDINANCE TO ESTABLISH
BUILDING PERMIT FEES FOR THE
CITY OF BANEBERRY, TN

BE IT ORDAINED by the City of Baneberry, Tennessee as follows:

Section 1. That the following Building Permit Fee, Moving Fee, Demolition Fee and Plan Checking Fee Schedule is hereby adopted:

$1,001.00 to $50,000.00 $50.00 for the first $1,000.00 plus $5.00 for each additional thousand or fraction thereof, to and including $50,000.00
$50,001.00 to $100,000.00 $295.00 for the first $50,000.00 plus $4.00 for each additional thousand or fraction thereof, to and including $100,000.00.
$100,001.00 to $500,000.00 $495.00 for the first $100,000 plus $3.00 for each additional thousand or fraction thereof, to and including 500,000.00.
$500,001.00 and up $1695.00 for the first $500,000.00 plus $2.00 for each additional thousand or fraction thereof.

MOVING FEE

For the moving of any building or structure, the fee shall be $100.00

DEMOLITION FEE

For the demolition of any building or structures, the fee shall be $75.00

PLAN CHECKING FEE

When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted, a plan-checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking. Said plan-checking fee shall be equal to one-half of the building permit fee as set forth herein. Such plan-checking fee is in addition to the building permit fee.

Note: The building official may waive the plan-checking fee if a plan check is not required.

Section 2. The Building Official shall determine the value of construction.

Section 3. The ordinance shall take effect immediately upon the passage of its second and final reading, the public welfare requiring it.

APPLICATION FOR PERMIT & INSPECTION REQUIREMENTS

The following items must be submitted to the Building Official in order to obtain a building permit from the City of Baneberry:

1. A completed permit application

2. Septic system permit

3. A plot plan showing the location of the building on the lot prepared by a licensed engineer or surveyor.

4. Two complete sets of working plans.

5. Name of contractor, state contractors license number and proof of contractor's workers compensation insurance.

Note: Owner-builder is not required to be licensed. However they will be responsible for any liability.

6. Payment for the full amount of the permit.

Permit fees will be determined by the value of the building (s) according to the schedule set forth in ordinance 203-7.

7. There will be 4 inspections:

     1. Footing & location Inspection:

         Lay out will be checked for proper lay-out, set-backs, and
         septic location. 
         Footings will be checked after they are dug and completely
         cleaned and all required reinforcing steel is in place, before
         placement of concrete.

     2. Foundation:
   
         Foundation will be checked before framing is started, for anchor
         bolts, reinforcement and all other hardware & waterproofing that
         is required.

In applying for a BUILDING PERMIT, the applicant SHALL abide by the Zoning Ordinances and

Building Codes adopted by the City of Baneberry, which include the International Residential Code for One- and Two-Family Dwellings 2000 and the International Building Code 2000 for Commercial.

Each application SHALL be accompanied by the following:

1. Two copies of a plot plan, showing boundary lines, setback lines, and location of the
structure on the lot, with certified surveyor's seal, date, and signature.

2. Two copies of the approved permit from the Tennessee Department of Environment and
Conservation for construction of Subsurface sewage disposal system (Form CN-762).

3. Two copies of building plans (blueprints) with sufficient detail and clarity to indicate the
nature of the work.

The APPLICATION FOR A BUILDING PERMIT must be submitted to the Building Official for issuance of the BUILDING PERMIT. After a PERMIT is issued, it SHALL be displayed at the building site until (A) Final building inspection is passed and (B) Certificate of Completion of Sewage Disposal System (Form CN-0872) is issued. When (A) and (B) are satisfied, a CERTIFICATE OF OCCUPANCY will be issued by the City Recorder.

I certify that the information herein is correct and true and any misrepresentations, either intentional or unintentional, constitute grounds for revocation of this permit.
